In fact, according to <a href=\"http:\/\/prsay.prsa.org\/index.php\/2009\/10\/09\/the-new-ftc-guidelines-cutting-through-the-clutter\/\" target=\"_blank\" rel=\"noopener\">The Public Relations Society of America<\/a> (PRSA), \u201cPeople who blog, tweet or use Facebook to post opinions about consumer products could be fined $11,000 for repeat violations of new federal disclosure rules.\u201d<\/p>\n<p><!--more--><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/fullfocus.co\/wp-content\/uploads\/2010\/01\/iStock_000001520756Small.jpg\" width=\"570\" height=\"403\" alt=\"Warning Tape Wrapped Around Laptop - Photo courtesy of \u00a9iStockphoto.com\/DNY59, Image #1520756\" title=\"Warning Tape Wrapped Around Laptop - Photo courtesy of \u00a9iStockphoto.com\/DNY59, Image #1520756\" \/><\/p>\n<div style=\"font-family:arial,helvetica,sans-serif;font-size:10px;margin-bottom:10px;margin-top:-12px;text-align:center; width:570px;\">Photo courtesy of \u00a9iStockphoto.com\/DNY59<\/div>\n<p>I don\u2019t know how serious the FTC will be in enforcing these guidelines. I have read some reports that indicate they will be primarily focused on advertisers who attempt to influence bloggers without requiring them to disclose that they were either paid or received free goods or services.<\/p>\n<p>In an attempt to decipher the new FTC Guidelines, <a href=\"http:\/\/prsay.prsa.org\/index.php\/2009\/10\/09\/the-new-ftc-guidelines-cutting-through-the-clutter\/\" target=\"_blank\" title=\"PRSA Post: \u201cThe New FTC Guidelines: Cutting through the Clutter\u201d\" rel=\"noopener\">the PRSA says,<\/a><\/p>\n<blockquote><p>The FTC dubs them [bloggers] \u201cendorsers\u201d and makes endorsers liable, along with advertisers, for false or unsubstantiated claims or for failing to disclose material connections between the parties.\u201d<\/p><\/blockquote>\n<p>What does this mean? It means that if you have a \u201cmaterial connection\u201d with a third-party advertiser or sponsor, you <em>must<\/em> disclose it. Specifically,<\/p>\n<blockquote><p>Bloggers who receive cash or in-kind payment (including free products or services for review) are deemed endorsers and so must disclose material connections they share with the seller of the product or service.\u201d<\/p><\/blockquote>\n<p>So how do we do this practically? A new Web site called <a href=\"http:\/\/cmp.ly\/\" target=\"_blank\" title=\"Cmp.ly Web Site\" rel=\"noopener\">Cmp.ly<\/a> (as in \u201ccomply\u201d) makes it simple for advertisers and bloggers to comply with the FTC guidelines. They have created a series of easy-to-use disclosures and codes that you can use in conjunction with your blog posts, tweets, and other social media interactions. They provide a standard list of six disclosures:<\/p>\n<ol>\n<li class=\"singlespace\">No Material Connection<\/li>\n<li class=\"singlespace\">Review Copy<\/li>\n<li class=\"singlespace\">Free Sample<\/li>\n<li class=\"singlespace\">Sponsored Post<\/li>\n<li class=\"singlespace\">Employee\/Shareholder Relationship<\/li>\n<li class=\"singlespace\">Affiliate Marketing Links<\/li>\n<\/ol>\n<p>They provide graphic \u201cbadges\u201d that you can insert in conjunction with your posts. The FTC does not require this and personally, I find them intrusive. I want to comply with the law, but I don\u2019t want an additional distraction or clutter.<\/p>\n<p>Originally, I thought it would be less intrusive to just insert a note after, for example, every affiliate link. As you probably know, if you mention a book on your blog and use your Amazon affiliate code, then Amazon will pay you a small commission when someone clicks through and buys the product. This approach looked like this:<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/fullfocus.co\/wp-content\/uploads\/2010\/01\/affiliate-link-example.png\" width=\"570\" height=\"93\" alt=\"Screenshot of an Affiliate Link\" title=\"Screenshot of an Affiliate Link\" \/><\/p>\n<p>However, after living with this for the past 30 days or so, I feel this is also cumbersome and intrusive\u2014especially if you have numerous links within one post, like I do <a href=\"https:\/\/michaelhyatt.com\/2009\/12\/12-gift-ideas-for-aspiring-writers.html\" target=\"_blank\" title=\"Post: \u201c12 Gift Ideas for Aspiring Writers\u201d\" rel=\"noopener\">here<\/a>.<\/p>\n<p>Therefore, I have decided to include one blanket disclosure at the bottom of every blog post. Rather than using a badge, I am using a simple block of text. I am using a smaller font (though still readable) and a slightly lighter color. This approach looks like this:<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/fullfocus.co\/wp-content\/uploads\/2010\/01\/affiliate-link-example-2.png\" width=\"570\" height=\"167\" alt=\"Screenshot of Disclosure of Material Connection Example\" title=\"Screenshot of Disclosure of Material Connection Example\" \/><\/p>\n<p>You can scroll down to the bottom of this post to see how it looks \u201clive.\u201d I currently have the following six disclosure templates. I am inserting at least one at the end of each post.<\/p>\n<ol>\n<li><strong>Disclosure 1: No Material Connection.<\/strong> This is the standard disclosure I use when I don\u2019t have any embedded links or a relationship with any of he products or services I have mentioned:\n<p><div class=\"callout\">Disclosure of Material Connection: I have not received any compensation for writing this post. Just put your default text in the plugin configuration page. I use Disclaimer 2 above for my default. Then you can then override this on a post-by-post basis, using a custom field.
